If you’re traveling to Australia for a study stint and want your partner to accompany you, the partner visa is your best option.

To apply, the partner who will be studying (main applicant) must include their partner (dependent applicant) in their student visa application for Australia.

This way, both partners can travel together to Australia and legally study and work in the country.

However, keep in mind that the conditions are not the same for both partners:

  • The student or main applicant can:
    • Work part-time during the course (24 hours per week).
    • Work full-time during vacations (48 hours per week).
  • While the dependent applicant can:
    • Only work part-time, whether it’s during vacations or the course (with an exception: if the student is pursuing a master’s or a Ph.D., the dependent can work full-time).
    • Study for a maximum of 3 months (for a longer course, they should apply for their own student visa).

    • Have a Confirmation of Enrollment (COE).
    • Possess a passport with a minimum validity of 6 months.
    • Draft and submit a Genuine Temporary Entrant (GTE) letter.
    • Secure Overseas Student Health Cover (OSHC).
    • Pay the student visa fee for the couple ($1,240 AUD).

    Depending on your nationality, the Australian Government may request additional requirements, such as proof of financial funds or medical examinations.

    Additionally, although not mandatory, the Australian Immigration Department recommends submitting all documents translated into English by an official translator.

    How to prove that you are a couple?

    Ideally, provide your marriage certificate or, at least, the certificate of being registered as a de facto couple. However, fret not, lovebirds; you don’t need to rush to Las Vegas for a quick wedding with an Elvis Presley impersonator. There are simpler ways to prove your genuine relationship, such as:

    • Joint bank accounts.
    • Evidence of being a couple for more than 12 months, like rental agreements, utility bills (water, electricity, phone, etc.).
    • Affidavits from family members (a perfect excuse to reconcile with in-laws and siblings-in-law).
    • Any document certifying shared assets: jointly owned car, mortgage, etc.
    • Airplane or train tickets and reservations in both names for trips taken together.

    You don’t need all of these, but the more evidence you provide, the better.

    If you apply for the student visa in Australia, your partner can accompany you with the partner visa (also called de facto visa). This distinguishes it from the Work and Holiday Visa, which does not allow including your partner within the visa.

    Can my partner work?

    Oh yeah! If one of the members enrolls in an English, VET, or TAFE course, the partner (with a De Facto visa) will have the right to work 24 hours a week.

    Can my partner study?

    Of course, but only for three months. If they want to study for a longer period, they will need to apply for their own student visa.
